Acceptance
By downloading, installing, or using Vesper (the “App”), you agree to these Terms of Service. If you do not agree, do not use the App. These terms form a binding agreement between you and the operators of Vesper.
License to use Vesper
Vesper grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not reverse-engineer, decompile, disassemble, or attempt to derive source code from the App. You may not redistribute the App or its components through any channel other than the official app stores.
You may not use Vesper to build a competing service, scrape editorial brief content for republishing, or train machine- learning models on the brief text. The editorial writing is the product, and the restriction protects the voice.
Commercial use
Vesper is licensed for personal use. Commercial use — including embedding forecasts in paid products, redistributing the editorial brief text, or using the sunset quality score in client-facing services — requires written permission. Contact brief@vespersky.ai for commercial licensing inquiries.
Your content
Photos taken through Sunset Verify are saved to your device’s Photos library. You retain full ownership and copyright of all photos. Vesper does not access, upload, or claim any rights to your photos, your journal entries, or your personal verification history.
Forecast accuracy disclaimer
Weather forecasts and sunset predictions are provided for informational and editorial purposes only. Vesper does not guarantee the accuracy of any forecast and is not a suitable source for safety-critical decisions.
Do not rely on Vesper for severe weather alerts, aviation, marine navigation, agricultural operations, emergency planning, or any decision where a wrong forecast would produce serious harm. Always use official government sources (National Weather Service, local emergency management) for life-safety decisions. The editorial voice in a Vesper Brief is meant to help you decide what to wear, not what to do in a tornado.
Prohibited uses
You may not use Vesper to violate any law, harass any person, infringe intellectual property rights, attempt to breach security, transmit malware, scrape or harvest data from the app in bulk, or reverse-engineer the sunset quality scoring algorithm. Users caught doing these things may have access revoked without notice.
Beta software
During the beta period, Vesper is considered pre-release software. Features may change, be removed, or behave unexpectedly. Data formats may evolve, requiring cached data to be reset. Users participating in the beta acknowledge these conditions as part of joining.
Subscriptions, trials, and purchases
Vesper is a paid app. Access to the full feature set requires either an active subscription or a one-time lifetime purchase. Plans currently available:
- Monthly ($2.99)— auto-renewing monthly subscription, 3-day free trial for new subscribers.
- Annual ($24.99)— auto-renewing yearly subscription, 3-day free trial for new subscribers.
- Lifetime ($59.99)— one-time purchase, perpetual access, no recurring charges.
Free trial. The 3-day free trial is available once per Apple ID. If you cancel before the trial ends you are not charged. If you do not cancel, the trial automatically converts to the paid subscription on day four using the payment method on file with your Apple ID.
Auto-renewal.Monthly and annual subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Apple charges the renewal to your Apple ID payment method. You can manage and cancel in the iOS Settings app: Apple ID → Subscriptions → Vesper.
Cancellation.Cancel any time in iOS Settings. Cancellation takes effect at the end of the current paid period — you retain access until then. Cancelling during the trial ends the trial immediately with no charge.
Refunds. All purchases are handled by Apple and subject to Apple’s refund policy. Submit refund requests through reportaproblem.apple.com. Vesper cannot process refunds directly.
Price changes. Subscription prices may change over time. When they do, Apple notifies existing subscribers and asks for consent before applying the new price. You can decline and cancel without being charged at the new rate.
Lifetime purchase.The lifetime purchase grants perpetual access to the current feature set and reasonable successors. “Reasonable successors” means we will not fragment the product into a second paid tier to deny lifetime users a feature they would reasonably expect; it does not guarantee every future feature regardless of cost. If an infrastructure-cost feature (e.g. a hosted AI service whose per-user cost materially exceeds Vesper’s own pricing) is added as an optional paid add-on, it may remain separately purchasable for lifetime users. This is the spirit of the commitment, not a loophole.
Limitation of liability
To the fullest extent permitted by applicable law, Vesper and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses.
Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid for the App in the twelve months preceding the claim.
Termination
You may terminate your relationship with Vesper at any time by uninstalling the App. Vesper may terminate or suspend your access if the Terms are violated, including for reverse- engineering, scraping, bulk downloading, or attempting to redistribute the App.
Because Vesper stores data locally and has no user accounts, termination typically means removing your device’s API access rather than deleting your data — your local photos, journal, and history remain yours and unaffected.
Changes to these terms
We may update these terms from time to time. When they are updated, the “Last updated” date at the top of the hero changes. Material changes will also be communicated via an in-app notice on next launch. Continued use of the App after changes are posted constitutes acceptance of the revised terms.
Governing law and disputes
These Terms are governed by the laws of the state of Illinois, United States (where iSimplifyMe LLC, the operator of Vesper, is organized), without regard to conflict of law principles. Any dispute arising out of or relating to these Terms will be resolved in the state or federal courts located in Cook County, Illinois, or at the user’s option, via binding arbitration administered by the American Arbitration Association.
Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be replaced with an enforceable provision that most closely matches the intent of the original.
